Former federal prosecutor David Weinstein said Cosby's celebrity nearly certainly played a role in the jury's deliberations, perhaps to convince "two or three jurors that it's impossible to convict Dr. Huxtable, to convict Fat Albert ... that he couldn't have done this disgusting thing".

Saturday's result was a victory for the comedian, who avoided up to a decade in prison, but the district attorney said his office would seek a verdict in a second trial.

The actor is being accused of drugging and molesting a woman at his home outside Philadelphia in early 2004.

As an alternate, Mike McCloskey heard all the testimony but didn't participate in deliberations.

It's possible the next jury could be selected in another county so as not to place too heavy of a burden on Allegheny County, where Pittsburgh is located, said Dennis McAndrews, a former Philadelphia-area prosecutor.

McCloskey posted his juror's badge on Facebook as proof of his role in the case. "Overtly arrogant, collaborating with the district attorney", said her statement, which was tweeted by her husband and read by an associate of the public relations firm representing Cosby.

He advised jurors when the trial ended, after a week of testimony and 52 hours of deliberations, that they need not discuss the case, even as the public debates whether age, race, gender or other issues separated them.

"My opinion continues to be that Ms. Constand was probably the victim of a sexual assault", said Castor, whom Constand is suing for defamation.

However, immediately after the ruling, prosecutors were quick to announce that they will retry the case, reports CNN.

Pennsylvania law allows the public release of jurors' identities, but judges have discretion to keep them a secret under certain conditions.

But the jurors clearly struggled with their verdict, telling the judge on Day 4 they were at impasse.

Mike McCloskey appears to be the first member of the sequestered 12-person jury or the panel of six alternates to speak publicly about the case. "It's an old case, it's a controversial case, it's a case that involves questions of consent", said professor Laurie Levenson, of Loyola Law School.

Prosecutors have already said they will retry Cosby and people on every side of the issue have used the outcome to argue their cause - from advocates for rape victims concerned that other victims won't be believed to those, including Cosby's wife Camille, who say the jurors resisting conviction stopped an unfair process out to ruin a successful man. His deposition testimony in her civil suit revealed the man who has a bestselling book about fatherhood had procured Quaaludes for the goal of having sex with women who were not his wife. The defense had hoped, if it did, to introduce evidence she had previously dated a man.

Constand's lawyer, Dolores Troiani, said only that the "jury is apparently working very hard".

Callan said the $33.5 million awarded in the case reflected the jury's reaction to a double homicide and was larger than a potential award to someone who has civil claims against Cosby. O'Neill could schedule the retrial within weeks.

Cosby is also battling sexual battery or defamation cases still pending by 10 women in California and MA. With the criminal case now set for a retrial, it appears that the MA civil case will be significantly prolonged.
