Lucas said that should the General Court not decide to review the ruling in the near future, this move "would contextualize Hamas as "terrorists" and set the political tone for the European Union going forward".

The lower court had found that the listing was based on media and Internet reports rather than decisions by a "competent authority".

"With regard to Hamas, the Court observes that the General Court annulled the continued freezing of funds exclusively on the ground that the Council had not referred, by way of justification, to national decisions by competent authorities".

The court said the European Union had not provided any evidence showing that the Tamil Tigers were a risk after their military defeat in 2009.

However, the top court on Wednesday overturned the 2014 ruling.

The EU imposed travel bans and asset freezes on Hamas, which controls the Gaza Strip, after the September 11, 2001, al-Qaeda attacks on NY and Washington, DC.

Hamas opposes the E.U.'s classification, claiming to have legal rights to war against Israel.

For the last decade, Hamas has been the de facto government of Gaza, while the Fatah-led Palestinian Authority has controlled the West Bank.
